What Happens to my House When I Die?

I attended a class today discussing the importance of having an Estate Plan in place in preparation for when you die.  No one likes to think about that, but inevitably it will happen.  One option to consider is a Lady Bird Deed (a couple hundred dollars).  When a Lady Bird Deed is in place, your property will get deeded to the recipient immediately upon your death.  You can avoid Probate Court (approximately $2,000 plus your waiting time) with this Deed and there will be no question with your family and friends with who is to receive your home when you die.  One benefit of a Lady Bird Deed is that while you are living, you can still have all your rights as a homeowner.  You can still sell, rent or refinance your home without any concerns.  You can also modify your Lady Bird Deed recipient at any time as well.

Another option can be a Trust.  This will usually include other assets along with your home.  This may be a good option if you have many other assets to distribute upon your death.  This is also a good tool that may avoid Probate Court and your family will be clear with your wishes.

A Life Estate Deed is also another option.  This is similar to a Lady Bird Deed, but does have some restrictions.  Best option is to talk with an Attorney who works with preparing Deeds to best discuss what is the appropriate option for you and your property.

Quit Claim Deeds are commonly used, but if they are not filed, there could be questions as to the validity of the Deed.  Also, there have been instances where the Deed is not properly written and to rewrite one after your death is obviously not possible.  This could possibly void that Deed.  Another consideration of a Quit Claim Deed is that you are actually deeding the house to them at that moment.  They are actually a part owner to your own.  You can't sell, rent or refinance without them.  If there are any legal issues with that person, your house now becomes an asset for them.  Lots to consider.

A Will is just a road map to your wishes.  It may not avoid Probate.

Things to consider.  Did you have a home in your name and then recently marry?  Are you living together with someone and only have one person currently on the deed to your home?  These are concerns that you should have discussions about now.  If that owner dies that is on the deed, the spouse or the co-habitat is not guaranteed the home just because they are living there.  It would be a great loss if they lost the home that they have been contributing to financially just because you weren't prepared.

The bottom line is to have something in place to avoid Probate.   Probate Court can be a long and costly process.  It may cost a little now to prepare, however, you may avoid larger costs and hardship afterwards.

Hey, it's Kelly Dix, out and about in Clinton Township.  Are you looking for a nice Italian restaurant?  Well I found one.  Aurelio's.  It's an Italian restaurant, so if you're looking to get your Italian fix on, this might be an option for you.  They're located on Garfield, just North of 19 mile, and you can definitely tell from the outside that it's an Italian restaurant.

Once you get inside, more Italian theme.  There are painted murals on the walls. Italian restaurant music playing in there and everything.  It was just really a quaint little restaurant.  Not a lot of seating, but I think it's just enough for quick lunch or a light dinner.  The restaurant had all kinds of Italian options in there to eat.   Pasta, veal, chicken, and all kinds of chicken options.  Of course, there's salad and soup too.

So if you're looking for a place to try, and looking, like I said, to get your Italian fix on, try them out.  It might be good option for you.  They're right off of Garfield, just north of 19 mile, and stop by and take a look.

Let's explore Clinton Township Michigan together!  This restaurant is located at 40280 Hayes, Clinton Township Michigan, just north of Clinton River Road.  First time visitor for me!  At first observation, the parking lot was pretty full for lunchtime.  I noticed that the building had an advertisement for an acknowledge for a top favorite restaurant from local Channel 4.  I walked in, greeted and seated promptly.  My first impression was good.  It looked like there have been some updates, and the layout was pretty nice.  There were booth areas, tables and chairs as well as a counter area possibly for the frequent coffee/breakfast visitors.  The restaurant opens early and closes early.  I noticed that they had daily specials as well as a Senior's Menu.  The service was very quick, and I was very happy overall with my whole visit.  I did notice that this restaurant has an additional private room that you can reserve with a deposit for meetings or gatherings.  Good location and great service for me.  I will be back.  If you are looking for a nice family style restaurant for breakfast, lunch or an early dinner, this would be a place to try!  Have you been there before?  What did you think?

Sledding Hill in Clinton Township Michigan

Snow Sledding

Sledding is a very popular thing to do during the winter months when it snows here in Michigan.  Did you know that Clinton Township is home to a sledding hill?  It is located near the Civic Center Park just off Romeo Plank and north of Clinton River Road.  Not all cities have one!  This sledding hill is open to everyone.  You do not have to be a resident of Clinton Township to enjoy it.  

The sledding hill does have certain guidelines that you need to pay attention to.  The walk from the parking lot is pretty far too, but that is all part of the fun!

Some sledding tips:

1.  Make sure to dress warm!  Definitely a hat, extra gloves and a scarf.  Your face will probably get chapped from the wind and sprays of snow while sliding down the hill.  Don't rule out a possible tumble at the bottom with a face full of snow as well!  Warm boots with extra socks inside is a must!  We always had blankets in the car to wrap up in when we were done with hot chocolate!

2.  Get your sled/tube early in the season!  Once the snow starts to hit, the sleds will fly out of the stores.

3.  Try taking the sled down with 2 riders!  It makes it a lot more fun!

Do Condos Appreciate In Value?

I often get asked if a condo purchase is a good investment.  I say that it is very similar to buying a home.  Are you planning on doing updates to the condo?  Is the association taking care of the complex?  Are the other condo owners taking care of their units?  What is the market like?  What are the other condos selling for in the complex?  What are they selling for around the complex?  These are all things to take into consideration when you are buying a condo.  Pretty much the same things that I would be considering when buying a home.  Check out my latest video!

 

If you are currently considering selling your condo, I would be happy to do a market analysis in your complex and the surrounding area.  If you are not ready to sell, I would try to do as many updates as you can while you are living there.  I say, enjoy the condo while you are there.  If you do nice and neutral updates, it will make your condo much easier to sell when you are ready!

Service Line Coverage

Michigan now has some options for "Service Line Coverage" in addition to your Home Owner's Insurance on your home.  Not all carriers provide this extra coverage.  You ask, "Do I really need this extra coverage?"  That is only something that you can answer.  As with any insurance coverage, it is for the unexpected.

You may want to have this insurance addition if you home is older and the service line is original to the home.  Do you have trees near your service line that could  possibly affecting the integrity of your service line?  Is the water pressure in your home less powerful than it should be?  A good idea may be to have your service line inspected by a plumber to see if there is any damage to it or any wear and tear.

Depending on the issue with the sewer line, a repair or replacement could cost upwards of $5,000.  Your normal home owner's insurance does not usually cover this repair or replacement.  The city does not usually cover it as well.  It is normally the home owner's responsibility.  If your insurance company does not provide it, reach out to my friend Tracy Colo at Insurance One to see if she can find an insurance company that can help.  Don't wait until it's too late or you may be digging up your yard, investing lots of money and possibly cleaning your basement when the problems happen.  You will want to compare the extra cost for the coverage as well as how much it will cover and if you have any deductibles.  Happy Home ownership!

Will the Seller Take Less?

Will the Seller Take Less?  Wow! Is this a loaded question or what? 

 

When I am looking at homes with buyers, I occasionally get asked this question.  I think a few reasons behind this question are; the buyer may want a deal, the buyer feels that it is overpriced, the buyer may feel that there are too many repairs needed and want to have those funds to do the work/updates.

In any case, the answer most likely is.... It all depends!

 1.  What Type of Market are We In?

Is it a Seller's Market?  A Seller's Market is to the advantage of the seller.  There are usually not enough homes on the market for buyers, and these homes are usually selling very quickly.  As a buyer, you will probably have a lot of buyer competition, and it is probably not a good time to offer less.  There may even be multiple offers or buyers bidding OVER the asking price.  Going in with a low offer does not really compete.  In this market, you will usually want to present your best offer because you might not get a chance to change it afterwards.  A seller does not have to offer a highest and best offer with multiple offer situations.  They can just choose an offer that is best for them.  This only gives you once change to make your best offer.  Once an offer is accepted, the buyer and seller are in a contract and cannot sign other offers.

On the other hand, if you are in a Buyer's Market, there are usually a lot of homes listed for sale.  The buyer usually has more control and negotiating power if they are a strong buyer.  A strong buyer is usually someone who has a pre-approval letter and possibly stronger with a pre-qualification letter, a larger down payment and not in need of seller concessions for help with closing costs.  In this situation, you may have an opportunity to "test the waters" with a lower offer.

2.  What is the Seller's Situation?

The seller may have a current mortgage still on the property.  Have they owned it for awhile, or did they recently buy it?  Do they have a home equity line or second mortgage tied to the property?  Are they going through a divorce and need to split the proceeds?  Are they in a short sale situation?  Is it an estate sale where they may have to prove taking a "fair" offer to settle the estate?  Bottom line is they may not be in a situation where they CAN take a lower offer.

When a seller lists their home for sale, the listing agent usually does a market analysis to find a competitive home value.  This is the price where the seller is expecting to sell.  Why should they sell their home for less than market value?  Most sellers want to get the most for their home.  If they wanted to get less, or they need to sell it quickly, they would probably list it for less.  If you were the seller...... would YOU take a lower offer???  If the sellers are listing it too high for market value, the listing agent is doing a disservice in my opinion.  They are leading the seller on.  Also, the seller will probably not be willing to negotiate much anyways if they feel that their list price meets the value.

4.  Buyer's Agent

This is a value of having a buyer's agent on your side.  Your buyer's agent can look at the same comparable properties that the listing agent is using and more than likely an appraiser as well.  If your agent doesn't feel that the seller will sell at market value, it may not be worth your time offering on the property, unless you want to bring the additional money to closing.  Why waste time and money on a home inspection and appraisal if the sellers won't or can't compromise if the value is not there?  Of course, you can always take a chance with the offer and see what happens.  Sometimes a seller hearing their market value from an appraiser does the trick.  They are already committed to the deal.  Anything can happen from offer to closing.

Selling During the Holiday-Should I Wait?

Should I Wait Until Spring?

Sellers often contemplate the question of listing their home for sale during the winter/holiday months or to wait until the spring season.  Sometimes you don't have a choice, but when you do, here are some things to consider.  There are some pros and cons in regards to putting your home up for sale during the Holiday Season in Michigan.

Benefits of Selling During the Holiday Season in Michigan

1.  Less Competition - There is probably going to be less competition for your home since a lot of other sellers are also thinking that they should wait until the busy spring selling season.  If you home is in good condition, and priced right, you should be able to attract a good buyer.

2.  House Usually Looks Very Nice - Since most people decorate during the holidays, your home will probably look very festive, clean and inviting!  You will have to have your home presentable during the showings anyways, why not make it look a little more welcoming and homey?

3.  Serious Buyers - Usually only the pretty serious buyers are out looking at homes in the middle of winter.  It's cold and snowy, and if they don't have to travel out and about, they are less likely to be looky loos.  They are out looking because they need to buy something soon.

4.  More Access to Services - During the off season, there is more of a chance that you will be able to have more flexibility with movers, repairman, inspectors and appraisers.  The demand for them might not be so high during this time.  This may help your process go a little smoother.

Disadvantages of Selling During the Holiday Season in Michigan

1.  Inconvenience - During the holidays, you may have out of town guests visiting, and everyone will have to relocate for showings.  You also may have to pack up your holiday decorations if you close before the holiday.

2.  Days on Market - If your condition is not great, or you are priced too high, you will have a large "days on market" number by the time the hot selling season hits.  Agents and Buyers will question why you haven't sold, and why this number is so high.

3.  Moving Day - One huge disadvantage is that you may be moving during inclement weather.  If you really don't have a choice to sell, you will just have to take your chances!

4.  No Choice - You may not have a choice, and you have to sell for various reasons.  Hopefully the process will be quick and smooth!
